1. Scope of Application

These terms and conditions apply to contracts for the delivery of digital content not stored on physical data carriers.

2. Right of Withdrawal for Consumers in Contracts for the Use of Digital Content

Consumers generally have a statutory 14-day right of withdrawal for distance contracts (such as purchases in our online shop). According to § 13 BGB, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Expiration of the Right of Withdrawal
In accordance with § 356 (5) BGB, your right of withdrawal expires if Chilling Sounds has begun executing the contract after you have:

Explicitly consented to us beginning the execution of the contract before the end of the withdrawal period, and
Confirmed that you lose your right of withdrawal upon the start of the contract's execution.

3. Data Protection

Personal customer data, including inventory and usage data, is collected, processed, and used in machine-readable form solely for the purpose of fulfilling the contractual relationship.

Personal data is used by Chilling Sounds exclusively to fulfill the contract. You may request information about the data stored about you at any time. Chilling Sounds treats this information confidentially and will never share it with third parties, except for partners who need the data to process the order or payment. Please refer to our privacy policy for further details.

4. Usage Rights

The audio files offered on this platform are licensed under the CC0 license and are therefore:

Royalty-free (GEMA-free)
Freely copyable by the purchaser
Fully usable in commercial environments (e.g., waiting rooms, restaurants, advertisements, videos, etc.)

5. Costs

Purchases are made at the prices specified in the product descriptions.

6. Warranty

If a file cannot be downloaded or is corrupted during download, Chilling Sounds will provide an appropriate replacement via an alternative delivery method (e.g., email, direct link, WeTransfer, or other options as agreed with you).

7. General Provisions

7.1 The place of performance is Schwentinental.

7.2 The law of the Federal Republic of Germany shall exclusively apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

7.3 If the customer is a merchant, a legal entity under public law, or has no permanent residence in Germany, the exclusive place of jurisdiction for disputes arising from or in connection with this contract is Schwentinental.

7.4 Chilling Sounds does not participate in dispute resolution proceedings before a consumer arbitration board.

7.5 Any side agreements, amendments, or additions require written form to be valid, as does the waiver of the requirement for written form itself.

7.6 If any provision of these terms and conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.
